iPES License AgreementThe iPES software program / package is provided to interested parties at no cost. Before using this software, you should carefully read the following terms and conditions. All use of this software is conditional upon your compliance with the license terms which follow. If you do not agree to the terms and conditions of this license agreement, you are not permitted to use the software. Using any part of the software indicates that you accept the following terms. Grant of License The Software Programm "iPES", herein called the SOFTWARE, is owned by ETH Zurich represented by Prof. Johann W. Kolar of the Power Electronic Systems Laboratory. ETH Zurich grants you, herein called the LICENSEE, the following non-transferable, non-exclusive rights of use. No title to the intellectual property in the SOFTWARE is transferred to the LICENSEE. The LICENSEE does not aquire any rights to the SOFTWARE except as expressly set forth in this License Agreement. ETH Zurich grants to LICENSEE the right to use the SOFTWARE for personal or non-commercial purposes including teaching purposes. The SOFTWARE may be transferred to the hard disk of any computer, or network of computers, belonging to the LICENSEE. The SOFTWARE may not be put on a website of the licensee or any other website of third parties without the express written consent of the ETH Zürich. Restrictions No license is granted to the LICENSEE in the source code of the SOFTWARE. The LICENSEE may not reverse engineer, reverse compile, disassemble, modify, translate, or alter the software and/or the associated files. The LICENSEE may not distribute, sublicense, lease, sell, rent or otherwise transfer the SOFTWARE, or any modification or derivative thereof, to any other individual or group for any reason. Limitations of Liability and Disclaimer of Warranties There are no warranty rights granted to the LICENSEE, regarding the SOFTWARE. The SOFTWARE and accompanying written materials, herein called the DOCUMENTATION, are supplied to the LICENSEE "as is" without warranty of any kind. ETH Zurich does not guarantee, warrant, or make any representations, either expressed or implied, regarding the use, or the results of the use of the SOFTWARE or the DOCUMENTATION with regard to reliability, currentness, accuracy, correctness, or otherwise. The LICENSEE assumes the entire risk as to the results and performance of the SOFTWARE or the DOCUMENTATION. ETH Zurich shall not be liable under any circumstances, for any damages whatsoever, arising out of the use, or the inability to use, the SOFTWARE, even if ETH Zurich has been advised of the possibility of such damages. Term and Termination This License Agreement is effective until terminated. The LICENSEE may terminate it at any time by destroying its exemplar of the SOFTWARE and the DOCUMENTATION together with all copies. It will also terminate immediately if the LICENSEE fails to comply with any term or condition of this License Agreement. Governing Law This License Agreement shall be governed by the laws of Switzerland.
